TERMS & CONDITIONS AND IMPORTANT NOTES

IMPORTANT – DO NOT USE THIS SERVICE FOR EMERGENCY MEDICAL NEEDS. Medical emergencies are not part of this service and HeartVoice users are advised to call 995 or MobileDoctor  24-hour hotline at 62500625.

This HeartVoice platform is operated by HeartVoice Pte Ltd (hereinafter “HeartVoice”), a joint venture between IAPPS Pte Ltd and Omron Healthcare Co., Ltd, registered in Singapore and having its registered office at Fusionopolis Symbiosis, 3 Fusionopolis Way, #13-25/24, Singapore 138633 (“HeartVoice”);

The telemedicine consultation (the “Consultation”) mobiledoctorclinic, a healthcare establishment registered under the Private Hospitals and Medical Clinics Act (PHMC), with its registered office at 20 Cross Street #02-11/12 Cross Street Exchange Singapore 048422 (“mobiledoctorclinic”)

Please note that HeartVoice and mobiledoctorclinic are independent third-party companies.

The Terms of Use (the “Terms”) and our Privacy Policy set the terms and conditions governing your use of the HeartVoice service (the “Service”). Please read the Terms and Privacy Policy carefully before using the Service. 

BY PURCHASING THE CONSULTATION, YOU ARE ENTERING INTO A LEGALLY BINDING AGREEMENT TO THESE TERMS OF USE AND THE PRIVACY POLICY (https://www.ourheartvoice.com/privacy-policy/). 

BY PURCHASING THE CONSULTATION, you further confirm that you are either (a) 21 years old and above; or (b) under the age of 21 and have received your parent’s or legal guardian’s permission to access this Service.

A. The SERVICE

1. The purpose of HeartVoice’s Service is solely to connect you with mobiledoctorclinic who will connect you with one of their licensed medical practitioners.
2. HeartVoice is not in the business of providing medical consultation or services. All medical consultation will be conducted by mobiledoctorclinic, and accordingly there will be no medical advice provided to you via this Service. 
3. There will be no doctor-patient relationship formed by using the Service. Any medical advice will only be provided to you during your telemedicine consultation with the licensed medical practitioner.

B. Your PERSONAL DATA  

1. Your Personal Data means any data about you which makes you identifiable (i) from such data or (ii) from that data and other information which HeartVoice has or likely to have access through the Service
2. You expressly agree and consent to the release and disclosure of your Personal Data  including your full name, mobile number and electronic mail (“Email”) to HeartVoice and mobiledoctorclinic for the purposes of: 

2.1. Contacting you via telephone, Email, SMS and/or any other means regarding the telemedicine service registration; and 

2.2. Contacting you via telephone, Email, SMS and/or any other means regarding HeartVoice’s other healthcare products and services. 

2.3 For customer service, marketing and other related activities in the future 

2.4 For disclosing your Personal Data to authorised service providers and relevant third parties, to perform certain functions in connection with the service 

2.5 Your clinical data or Personal Data disclosed to the mobiledoctorclinic and/or the licensed medical practitioner will not be shared with HeartVoice and ActiveSG.  

2.6 Pre registering on the Heartvoice’s mobile application (the “HeartVoice Mobile App”). Upon the launch of the HeartVoice Mobile App for the public, you will receive an email with instructions on setting up your account. 

C. Consultation 

1. You agree to either web-based video Consultations or a smartphone video Consultation with mobiledoctorclinic. Consultations are purchased in form of a session voucher, upon purchase, a session ID will be sent to you via SMS and the expiry date of the session will be 30 days from the date of purchase.
2. The session voucher is non-refundable and cannot be exchanged for cash in part or full and is valid for a single consultation only
3. The Consultation may also include diagnosis and provision of medical advice and where necessary the prescription of medicine.
4. The licensed medical practitioner and mobiledoctorclinic shall be responsible for all advice given to you and HeartVoice will not be held liable for any misdiagnoses, acts or omissions of the licensed medical professional. HeartVoice does not endorse any medical screenings, tests, procedures, medication, product, opinion, diagnosis or any other information that may be mentioned during the Consultation. 
5. In conjunction with the ‘Support The Courage Fund’ campaign that is on-going, all consultation fees (flat fee of $5 per consultation) will be donated by mobiledoctorclinic to this cause. Please note that the $5 consultation fee excludes GST, and any additional charges such as medication or delivery charges (where applicable). You are responsible for any and all consultation fees, medication, medical tests, imaging and examination, if any.

D. LIABILITY 

1. You accept that HeartVoice is not responsible and shall not be liable for any claims, costs, actions or proceedings, loss or damage that may arise out of or in relation to the use of the HeartVoice platform.
2. HeartVoice is not responsible and shall not be liable for the disclosure of your Personal Data to third parties pursuant to your request; and/or (iii) HeartVoice’s use, collection and disclosure of your Personal Data. Notwithstanding the foregoing, HV remains responsible for your Personal Data in its own possession pursuant to its Personal Data Protection Policy and its compliance with applicable data protection laws. 
3. SportSG shall not be responsible or liable for any action, omission, advice, services, products or solicitation efforts provided by HeartVoice and/or mobiledoctorclinic

E. OTHERS

1. The terms and conditions of the service shall be governed by the laws of Singapore and you agree to be bound by the exclusive jurisdiction of the courts of Singapore in relation to all disputes arising out of and in relation to the service.
